Tax advice fornon-residents in Mallorca

Tax advisers and lawyers for foreign property owners and non-residents

If you own a home, investments or have family in Mallorca but live outside Spain, several sets of rules apply at once: Spain’s, those of your country of residence and, where relevant, a double tax treaty. From our office in Manacor we advise foreign property owners and non-residents, with particular experience of clients from Germany and the United Kingdom.

We review your whole situation: where you are tax resident, what is taxed in Spain and what in your home country, which returns you must file and what is worth putting in order on wealth and inheritance. We work in Spanish, English and German.

What a non-resident with assets in Mallorca has to deal with

These are the issues we review most often with foreign owners. Where one exists, we link our team’s analysis.

Renting out your property: IRNR

Rental income is taxed under Non-Resident Income Tax (IRNR) and reported on form 210. The rate and base depend on where you live: 19 % with deduction of expenses for residents of the EU or EEA with effective exchange of information; 24 % on gross income for everyone else.

Property that is not rented: imputed income

A property in Mallorca that is not rented also generates imputed income, calculated as a percentage of its cadastral value and reported on form 210. The rule that applies should be checked every year.

Selling the property

The gain is taxed under IRNR. The buyer must withhold and pay 3 % of the price as an advance payment (form 211), and the withholding is settled afterwards when the gain is declared.

Wealth tax

A non-resident is taxed on assets located or exercisable in Spain and may apply the rules of the autonomous community where the greater value of their assets lies. In the Balearic Islands the exempt minimum is €3,000,000 and non-residents can also apply it, but to do so they must always file the return (form 714) opting for the Balearic rules, even if no tax is payable.

Inheritance and gifts

A non-resident is taxed on assets located, exercisable or enforceable in Spain and may apply the regional rules that fit the case. The Balearic reliefs have changed in recent years.

Treaties and double taxation

The treaties with Germany (2011) and the United Kingdom (2013) allow Spain to tax property located here and require your country of residence to eliminate double taxation. We check which one applies in your case.

Buying a home in Mallorca

Transfer tax, stamp duty and tax incentives for housing in the Balearic Islands, analysed before you sign, and the owner’s obligations afterwards.

Tax residence: arriving and leaving

More than 183 days is not the only test: the centre of economic interests and where your family lives also count. We look at a change of residence, both when you move to Mallorca and when you leave.

Wills and the law governing your estate

Under EU Regulation 650/2012 the applicable law is, in general, that of your habitual residence at death, and you may choose the law of your nationality. We check that the wills made in each country are consistent with each other.

How we work

1. Inventory and first meeting

We gather your assets in Spain and abroad, your residences, your family situation and any wills and deeds you have.

2. Analysis

We determine your tax residence, the applicable treaty and which Spanish taxes affect you.

3. Returns and filings

We prepare and file the returns that apply and explain which deadlines you need to watch.

4. Defence and follow-up

If the Spanish Tax Agency sends a request or opens a review, we defend you as tax lawyers.

Regional rules, treaties and case law change often, so we review your case every year and not only when a return is due.

Frequently asked questions

Am I tax resident in Spain if I spend fewer than 183 days in Mallorca?

You may be. Article 9.1 of the Personal Income Tax Act also looks at where the main centre or base of your activities or economic interests lies, and presumes residence where your spouse (if not legally separated) and dependent minor children habitually live in Spain.

What taxes does a non-resident pay on a home in Mallorca?

It depends on how it is used: rental income, imputed income on a property that is not rented and the gain on a sale are taxed under IRNR. You may also be subject to wealth tax on assets located in Spain and, where relevant, to inheritance and gift tax.

Which rate applies if I am German or British?

It depends on where you live, not on your nationality. A resident of Germany, like residents of other EU or EEA states with effective exchange of information, is taxed at 19 % and can deduct rental expenses. A resident of the United Kingdom, which is no longer an EU member state, is taxed at 24 % on gross income, although the deduction of expenses is a point being argued in the courts.

Who withholds tax if I sell my home in Mallorca?

The buyer must withhold and pay 3 % of the consideration on account of the non-resident seller’s tax, using form 211.

Do I need a representative in Spain?

The tax authorities may require a representative from anyone who owns property in Spain and is not resident in the EU or, under the terms of the law, the EEA (Article 10.1 of the consolidated IRNR Act).

Do I have to file form 720?

The rules for this reporting return on assets held abroad are addressed to people resident in Spain and to permanent establishments in Spain. If you become resident in Spain, the obligation has to be assessed.

Can I choose the law that governs my estate?

Yes: you may choose the law of the State whose nationality you hold, expressly in a disposition of property upon death (Article 22 of Regulation 650/2012). Without a choice, the law of your habitual residence at death applies.
